Illegal Employment.

A condition for issuing a certificate of the possibility of filling a vacant job, which includes consent for its occupancy, and a condition for granting a work permit is that the employer, user employer, or hosting entity interested in hiring a third-country national has not violated the prohibition of illegal employment within the five years preceding the application for a residence permit for employment purposes and the application for a work permit.

For violating the prohibition of illegal employment, the central authority or office may impose a fine on a legal entity or an individual ranging from €2,000 to €200,000. If it involves the illegal employment of two or more individuals simultaneously, the minimum fine is €5,000.
