Temporary Residence for Employment Purposes Based on Employment Permit .

The police unit grants the permit to a third-country national unless there are grounds for its rejection.

The employment permit is issued by the local labor, social affairs, and family office based on a written application from the third-country national, employer, or legal entity or individual for whom the third-country national will be dispatched to work.

There is no legal entitlement to the issuance of the employment permit.

The labor, social affairs, and family office may grant the employment permit to a third-country national who:

will be employed for seasonal work for a maximum of 90 days during 12 consecutive months, will be employed as a seafarer on a ship registered in the SR or a ship flying the flag of the SR, has been granted temporary residence for the purpose of family reunification within the period of 12 months from the granting of temporary residence for the purpose of family reunification, has been granted temporary residence as a third-country national with recognized long-term resident status in a member state of the European Union, in the period within 12 months from the start of residence in the territory of the Slovak Republic if not otherwise provided by the Foreigners Residence Act, if stipulated by an international treaty to which the SR is bound. The employment permit is non-transferable and is granted for a specific position with a specific employer.

Employment without an employment permit, confirmation of the possibility to fill a vacant position corresponding to a highly qualified job, or confirmation of the possibility to fill a vacant position.

The category of persons, third-country nationals, for whom no confirmation of the possibility to fill a vacant position corresponding to a highly qualified job, confirmation of the possibility to fill a vacant position, and an employment permit is required upon entry into the Slovak labor market is exhaustively determined by the Employment Services Act (ยง23a).
